Rules and Regulations

Assumption of Liability and Indemnification:

Renter acknowledges and agrees to assume liability for any injuries, damages, or losses arising from the use of the EyecanAthletics facility, equipment, or services. Participation in sports and physical activities involves inherent risks. By renting the facility, the Renter releases and holds harmless EyecanAthletics, its officers, employees, agents, and affiliates (the "Released Parties") from any liability, including:

  • Personal injuries, including death, to the Renter or any participant.

  • Damage to or loss of property.

  • Any claim, demand, or cause of action arising from or related to the rental.

Indemnification:

The Renter agrees to indemnify, defend, and hold harmless the Released Parties from any claims, demands, or actions that:

  • Arise from the Renter's use of the facility.

  • Are caused by the Renter's negligence or willful misconduct.

  • Result from any breach of this Agreement.

Insurance Requirements

The Renter must obtain and maintain liability insurance coverage with respect to their use of the facility. The insurance policy must:

  • Name EyecanAthletics as an additional insured.

  • Provide coverage for bodily injury and property damage.

  • Have a minimum limit of liability of Amount

Acknowledgment:

By using the facility, the Renter acknowledges that they have:

  • Read and understood this Agreement.

  • Voluntarily assumed the risks associated with using the facility.

  • Released the Released Parties from any liability.

Governing Law:

This Agreement is governed by and construed in accordance with the laws of Texas.

Emergency Contact Information:

The Renter is required to provide EyecanAthletics with emergency contact information, including:

  • Name

  • Phone number

  • Email address

Responsibilities:

  • Safety: The Renter assumes liability for any injuries or damages that occur during their rental period.

  • Cleanliness: The Renter is responsible for maintaining the cleanliness of the facility during the rental period.

  • Security: The Renter is required to ensure the facility's security throughout the rental.

Cancellation Policy

At EyecanAthletics, we understand that unforeseen circumstances may arise. While we do not offer refunds, we provide rental credits for future use based on the following guidelines:

Cancellation Notice Periods:

  • 48 hours or more prior to the rental date: 100% credit towards future rental.

  • 24-47 hours prior to the rental date: 50% credit towards future rental.

  • Less than 24 hours prior to the rental date: No credit will be issued.

Cancellation Procedures:

  • Notify EyecanAthletics in writing (via email or fax) of the cancellation.

  • Provide the rental date, time, and original payment information.

  • Credits will be issued within 5 business days.

Credit Terms:

  • Credits are non-transferable.

  • Credits expire 6 months from the issue date

  • .Credits can only be used for future rentals at EyecanAthletics.

No-Shows:

Failure to appear for a scheduled rental without prior notice will result in forfeiture of payment.

Exceptions:

EyecanAthletics reserves the right to cancel or reschedule rentals due to unforeseen circumstances. In such cases, full credits will be issued.

Acceptance

By renting our facilities, you acknowledge that you have read, understood, and accepted these rules, regulations, and the cancellation policy.
